INVESTMENTS & MIGRATION IN THE USA - IMPORTANT CHANGES IN 2023

Established in 1990, the EB-5 Immigrant Investor Program is one of the worlds most popular investment visa programs. The program is strongly supported by the US Government, which helps stimulate and support the national economy through job creation and capital investment from foreign investors.

EB-5 allows foreign investors to legally live and work in the United States. The investors family receives a green card and has US permanent resident status. Investors will choose to contribute capital to a project or business in the US.

Children study for free until the end of high school, have the right to enroll in top US universities that are only available to US residents, and enjoy all support regimes.

Investment in the US is faster, but the immigration process is more complicated. There are tougher requirements for qualifications or intermediate investments. LATEST UPDATE ON THE EB-5 PROGRAM

On March 15, 2022, the EB-5 Immigrant Investor Program was officially renewed by the US Congress after being suspended on June 30, 2021.

Under the EB-5 Reform Act, new applicants will have to invest a minimum of $800,000 in a TEA (Targeted Employment Area – An area with unemployment as high as 150% of the national average). countries) and $1,050,000 into the Non-TEA (Targeted Non-Employment Area). The minimum investment amount in these two areas will be kept steady until 2027.

2. Investment forms:

• Direct business investment

An investor invests $800,000 or $1,050,000 in a US-based business in a TEA or Non-TEA area. This business must be established by the investor or acquired by the investor in operation. This form requires the investor to directly run the business and must create 10 full-time jobs for 2 consecutive years.

• Invest through a regional center

An investor invests $800,000 or $1,050,000 in a regional center project in a USCIS-approved TEA or Non-TEA area. Investors do not have to directly run the business but only need to contribute capital to create 10 jobs per investment. This is the simplest form chosen by the majority of Vietnamese investors.

3. Conditions of participation:

• Applicant over 18 years old. Meet health and criminal record requirements.
• No qualifications, qualifications, or management experience are required.
• Invest $800,000 in an EB-5-eligible project.
• Create 10 jobs for local workers.
• Prove that the EB-5 investment capital is from lawful origin.
